These Terms of Service ("Terms") govern your use of DNA Rider tags, the dnarider.com website, and related services (together, the "Service"). By purchasing a tag, claiming a tag, creating a profile, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

DNA Rider is a supplementary identification tool. It is not a medical device, not an emergency response service, not a tracking or anti-theft device, and not a substitute for medical identification jewelry, emergency communication equipment, insurance, or common sense. Never rely on the Service as your only means of being identified or of reaching help.

1. What the Service does

A DNA Rider tag is an NFC chip that, when tapped by an NFC-capable phone, opens a web page showing the information the tag's owner chose to make public. Cryptographic authentication indicates that a tag was issued by DNA Rider; it does not verify the accuracy of any information a user has entered.

2. No guarantee of availability

The Service depends on factors outside our control, including network connectivity, the finder's phone, physical condition of the tag, and the availability of our servers. We do not guarantee that the Service will be available, uninterrupted, or error-free at any particular moment — including during an emergency. Tags can be damaged, removed, or fail. Information is displayed only as current as the owner last saved it.

4. Not medical advice or a medical device

The Service stores and displays information you provide. We do not review it, and nothing in the Service constitutes medical advice. Medical professionals and first responders use their own judgment; we make no representation that any responder will scan, read, or act on a tag.

5. Theft reporting

Marking an item stolen displays a notice to people who tap the tag. It does not notify law enforcement, track the item, or guarantee recovery. Pursue theft through law enforcement and your insurer.

6. Limitation of liability

To the maximum extent permitted by law: the Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. DNA Rider and its operators shall not be liable for any indirect, incidental, special, consequential, or exemplary damages — including personal injury, death, property loss, or theft — arising from or related to use of, or inability to use, the Service, even if advised of the possibility of such damages. Our total aggregate liability for any claim shall not exceed the amount you paid us for the tag(s) giving rise to the claim in the twelve months before the claim arose.

Some jurisdictions do not allow certain exclusions or limitations; where they apply, our liability is limited to the fullest extent the law allows.

7. Indemnity

You agree to indemnify and hold DNA Rider harmless from claims arising out of your content, your use of the Service, or your violation of these Terms.

8. Account termination and changes

You may unclaim your tag and delete your profile at any time from the owner page. We may suspend or terminate access that violates these Terms. We may update these Terms; continued use after an update is acceptance. Material changes will be noted by revising the date above.
